Confirmation of Alcohol and/or Drug Rehabilitation

If one of your offenses includes either a DUI charge or any conviction related to the use, possession or trafficking of prohibited drugs, it is very important to produce documented evidence proving that you have not used any of these substances, with which you were previously charged, over the past 12 months.

A negative test result for the use of any substance is given when the level found in a hair sample, which Viaguard laboratories analyses, is under the limits established by regulatory agencies.

Viaguard laboratories (a leading alcohol and drug forensic testing facility), whose work is accepted by courts and legal authorities, will arrange to have a small sample of your hair tested and the results made confidentially available to you.

We would strongly recommend that a negative usage test, covering previous one year periods, be submitted as evidence of your drug and/or alcohol rehabilitation. This legal report is compelling evidence, which may facilitate parole board approval of your application.

The costs of this testing, which is about $175, may be money well spent.

Rehab

AN IMPORTANT AND EXCLUSIVE ACCU-METRICS OPTION

YOU ARE NOT REQUIRED TO HAVE REHABILITATIVE INSTRUCTION but in both pardon and Record Suspension and waiver applications, the decision making tribunals have indicated a preference for documented evidence of rehabilitation.

Accu-metrics now has available an intensive optional course in criminal rehabilitation which can be taken at a convenient time and place, or by the internet.

You will be issued a certificate indicating your successful participation and this may be very helpful in your application as this step indicates to the decision making officials that you are serious about leading a rehabilitative life. This course will not delay your application and MAY ASSIST IN EXPEDITING ITS APPROVAL. Cost of this optional course is $100.00.

This is the certificate you receive on completion of the course, a copy of which will be submitted with your application.

A criminal record is an impediment to where you can work, volunteer, travel and live. It will affect every facet of your social and economic well being. Anyone convicted of a criminal offence has a criminal record.

Many people are not aware of the fact that once you have been fingerprinted and a charge has been laid, even if it has been dropped, you have been acquitted, or received an absolute, or conditional discharge you have a non-conviction criminal record and may be unable to pass a police clearance. The board is an independent administrative tribunal that has exclusive authority for making decisions to grant, deny, and revoke pardons under the Criminal Records Act and the Criminal Code of Canada.

The board is an agency within the Ministry of Public Safety Canada and is composed of 72 members in regional offices across the country.

What happens to your criminal record?

After a pardon / Record Suspension is issued your record is removed from searchable systems (CPIC) within a 30 days period. The pardon board issues a directive to all federal agencies including the RCMP to implement this policy.

The pardon board requires local police agencies to follow this procedure within 90 days, and all court records are removed and placed under seal with no access except by you.

U.S. Waiver

A Canadian pardon will not remove your name from the U.S. Customs and Border Services data base of persons prohibited from U.S. entry. You may be in their data base for a variety of reasons which include prior charges and convictions in Canada, illegal entry to the U.S. on previous occasions and illegally working in the U.S. Unfortunately there is no certain way of ascertaining what is stored in the U.S. computer system because all this information is considered classified. U.S. Customs may be tolerant of certain minor offences such as driving under the influence of alcohol, juvenile delinquency, trespassing etc., but in all cases allowing entry is at the discretion of the individual Border Officer you encounter.

There are certain crimes which are regarded by the U.S. as crimes of moral turpitude and here there is no doubt that you will be denied entry. These offences would include drug possession or trafficking, fraud, arson, blackmail, robbery etc. You will absolutely require a waiver for U.S. entry if ever convicted or charges with a crime of moral turpitude.

If you have reason to be concerned Accu-metrics should apply for your U.S. Waiver which will allow unconditional entry. Waivers are issued by the U.S. Department of Homeland Security whose authority overrides any discretionary powers of U.S. Customs and Border Services agents.

The fee for a waiver is $399.00 plus fingerprinting costs of $49.00 plus $25.00 for an RCMP certificate, which Accu-metrics will obtain for you. When your final U.S. waiver application is filed there is a fee payable to U.S. Homeland Security of $585.00 U.S.

FOR MOST PEOPLE THE WAGES OF A CRIMINAL OFFENCE ARE POVERTY

Accu-metrics review of the proposed government "Get Tough On Crime" legislation indicates areas of concern that appear to be overlooked or misunderstood. Further, there are serious doubts about the proposed intention of lengthening the period of time required for pardon and Record Suspension eligibility.

In a large number of interviews with persons seeking a pardon and Record Suspension or those who have obtained one, certain facts become evident.

One relevant theme is that for many, a criminal record resulted in expensive legal bills, fines, incarceration, loss of subsequent employment opportunity and many other setbacks for the person and their family.

The benefits "material or emotional", of what in most cases was a less than major crime, turned out to be detrimental.

In the 5-year period after being granted a pardon and Record Suspension a recipient is 70% less likely to reoffend than a person who has never applied for or been granted a pardon.

These numbers mirror an extensive study done by Correctional Service Canada about a decade ago. Their conclusion stated "we should be equally concerned about the risk to public safety posed by offenders who are not paroled. These offenders are a greater risk to the community, in that their reoffending rates are so much higher than those of parolees".

The granting of a pardon in a timely manner is a proven deterrent to reoffending. The Parole Board of Canada should be given the additional resources needed to facilitate the process. They do an admirable job, but are over burdened resulting in major delays.

The issuance of a pardon has multiple positive effects on a person's life. It opens employment and educational opportunities, restores a sense of personal worth and dignity, and is a definite stimulus to avoiding a recurrence of problems.
While serious offenders particularly those whose offences include crimes of moral turpitude will need special attention, the vast majority of offenders are characterized as having been naïve, foolish, easily influenced, and under emotional or financial pressure. Many were involved with drugs or alcohol. While these are not excuses for criminal acts, they should not form the basis for exaggerated punitive measures. The offenders family are often collateral victims of the misdeed.

Rehabilitative services should be made more accessible, they have an important role to play. At Accu-metrics regardless as to whether the applicant has already taken a rehabilitative program or not, they are encouraged to take the Accu-metrics course which can be done at our facility or online. Applicants are then required to complete a questionnaire as to their interpretation of the program, how it will assist them, and are given a verbal interview. The response has been favourable.

While even a large number of interviews and applicants do not produce statistically valid conclusions, nevertheless what emerges is a clear indication that the granting of a pardon and Record Suspension has profound positive effects on the life of an individual and the society they live in.
